These Terms of Use ("Terms") are a legally binding agreement between you ("User", "you", or "your") and Smitten Technologies, having its principal place of business in Delhi, India ("Smitten Technologies", "Company", "we", "our", or "us"), governing your access to and use of TruSight applications, websites, APIs, software, and related services (collectively, the "Service").
Please read these Terms carefully. By downloading, installing, registering for, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Definitions
- Account — a user account created to access the Service.
- AI Output — scores, summaries, reports, explanations, citations, transcripts, OCR text, trust indicators, authenticity estimates, or other content generated by the Service.
- Content — text, images, screenshots, video, audio, URLs, metadata, documents, transcripts, or other information submitted to or processed by the Service.
- Sherlock — optional screen-capture and assist features within the Service (platform-specific; see Section 7).
- Truth Vault — anonymized result cache used to speed up similar checks (see Section 9).
- Trust Ring — any visual trust, confidence, or credibility indicator generated by the Service.
- Document Check — optional analysis of photographs, PDFs, Word files, or similar files you submit to estimate document or identity authenticity, writing originality, or related claims (see Section 6A).
- User Content — content you submit, upload, record, capture, paste, link, or transmit through the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service. If you are under the age of majority, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You represent that you have legal capacity to enter these Terms, that your use complies with applicable law, and that information you provide is accurate.
The Service may not be available in all countries. We may restrict access in any jurisdiction at our discretion.
2. Accounts and security
2.1 Account required
In production, the Service may require an Account to submit content for analysis. Supported sign-in methods may include email/password, Google, phone verification, Microsoft, and Sign in with Apple where available on your platform.
2.2 Your responsibility
You are responsible for safeguarding your credentials and all activity under your Account. Notify us promptly at info@smitten.co.in if you suspect unauthorized access.
2.3 Account termination and deletion
We may suspend or terminate Accounts that violate these Terms or pose security or abuse risk.
You may request deletion of your Account and associated personal data as described in our Privacy Policy and data deletion page.
3. Description of the Service
TruSight is an AI-assisted informational analysis tool that helps users evaluate claims and media they choose to submit.
The Service may analyze text, screenshots, images, OCR text, video files, supported video links, audio/transcripts, URLs, photographs and scans of documents, PDF and Word files, and related signals. It may generate Trust Rings, authenticity or confidence scores, summaries, source references, fact-check style reports, scam-risk signals, document authenticity estimates, identity-document checks, writing-originality estimates, and other AI Outputs.
The Service is informational only. It does not determine truth, falsity, authenticity, legality, credibility, or reliability with certainty.
We do not guarantee uninterrupted availability, uptime, response times, or compatibility.
4. Not professional advice
The Service does not provide legal, medical, financial, investment, tax, insurance, security, emergency, law-enforcement, investigative, identity verification, KYC / e-KYC, background-check, immigration, employment screening, admissions, lending, or other regulated verification advice.
AI Outputs are not a substitute for qualified professional guidance or for verification through an official issuer, government portal, DigiLocker, NAD, university, employer, bank, or other primary channel. You are solely responsible for decisions you make based on the Service.
5. AI limitations and user verification
The Service uses artificial intelligence, machine learning, search tools, OCR, transcription, and automated analysis. These systems may produce errors, hallucinations, incomplete or outdated information, bias, or incorrect conclusions.
Trust Rings, scores, and similar outputs are algorithmic estimates only — not statements of fact. You agree to independently verify information through primary sources before relying on, sharing, publishing, or acting on AI Outputs.
5.1 High-risk uses prohibited
The Service is not designed for healthcare diagnosis, emergency response, military operations, aviation, law enforcement, judicial decision-making, critical infrastructure, child-protection investigations, or other safety-critical uses. Such use is at your own risk.
6. Media authenticity, fact-checking, and reputation
The Service may attempt to identify manipulation, synthetic media, misinformation, or scam patterns. We do not guarantee detection of all deepfakes, edits, AI-generated media, or deceptive content. A low-risk signal does not prove authenticity; a risk signal does not prove fraud.
Assessments relating to people, organizations, governments, or public figures are automated and are not factual determinations, certifications, journalism, or reputation ratings. We are not liable for reputational harm, publication decisions, or other consequences from reliance on AI Outputs.
6A. Document and identity checks
When you use Document Check (or similar document / ID features), you may upload or photograph documents such as government identity cards and passports, invoices and tax documents, education or professional certificates, vehicle papers, civil certificates, letters, or other files the Service can attempt to classify.
Depending on the file and available signals, the Service may:
- Extract text with OCR (including from scanned PDFs)
- Classify the capture (for example identity document, issued document, writing sample, claim-bearing content, or not a document)
- Run local format or checksum checks on identifiers
- Compare extracted identifiers or images against third-party registry or verification APIs where configured
- For identity documents, where configured, search third-party FIR and court record APIs using name and address extracted from the document (and father’s name or date of birth only if already extracted) — not ID numbers or images
- Estimate writing originality using automated and third-party detectors
- Produce Trust Rings, bands, summaries, “what we checked” rows, and safe-action guidance
Important limitations — read carefully:
- Document Check is informational only. It is not government verification, DigiLocker or NAD confirmation, university or employer confirmation, KYC / e-KYC, certified forensic analysis, or legal proof that a document is genuine or forged.
- A registry “match,” “likely authentic,” or similar label does not mean we vouch for the holder’s identity, that the document is currently valid for any official purpose, or that you should accept it for employment, admissions, lending, travel, or compliance.
- OCR, registries, AI models, and detectors can be wrong, incomplete, outdated, or unavailable. Missing registry coverage is incompleteness, not proof of fraud.
- Legal-record rows are reported proceedings, not proof of guilt, conviction, or that a person is a criminal. An empty result is not proof that no FIRs or cases exist in India. This screening is not a regulated background check, employment screen, or law-enforcement finding, and it does not change authenticity bands.
- You must independently verify important documents with the issuing authority or an official channel before relying on any AI Output.
You represent that you have a lawful right to submit each document (including documents that contain other people’s personal data) and that your use complies with applicable privacy, employment, and identity laws.
7. Sherlock, screen capture, Share, and device permissions
Optional Sherlock and related capture/share features work only after explicit user action and system permission approval. We do not continuously monitor, record, or surveil your device.
Android: Features may require display over other apps (floating assist), media projection, microphone (if you enable audio during recording), and access to photos or videos you select.
iOS: Features may require Broadcast Upload / screen recording, microphone (if you enable audio during recording), photo/video library access for media you select, and use of the Share Extension to send links or media from other apps. Live Activities and notifications may be used to show analysis progress or completion when permitted.
You are solely responsible for ensuring you have the legal right to capture, upload, and analyze content, including content involving other people, private communications, platform terms, copyright, or confidentiality obligations.
8. User responsibilities
You are solely responsible for:
- Verifying AI Outputs before use
- Deciding whether to share results
- Complying with applicable laws and third-party platform rules
- Protecting your own interests and rights
9. User content and license
You retain ownership of User Content. By submitting User Content, you grant Smitten Technologies a worldwide, non-exclusive, royalty-free license to receive, process, analyze, transmit, temporarily store, display, and reproduce it only as needed to operate and improve the Service.
You also authorize us to create and store anonymized, redacted copies of analysis results (not necessarily full raw submissions) for up to 30 days to operate Truth Vault, a result cache that may speed up similar checks for you and other users, as described in the Privacy Policy. The cache is not a public database of user submissions and entries are not linked to your account. Truth Vault is part of the Service for all users while enabled on our servers; there is no in-app opt-out. We may disable or change the cache globally for operational, security, or legal reasons.
You represent that you have all necessary rights and that your User Content does not infringe third-party rights or violate law.
If you create a share link, you authorize us to store a limited result summary so the link can be opened by recipients you share it with.
10. Prohibited uses
You must not use the Service to:
- Break the law or violate others' rights
- Harass, stalk, or defame individuals
- Infringe intellectual property or privacy rights
- Distribute malware or conduct fraud
- Engage in unauthorized surveillance
- Manipulate elections or spread coordinated disinformation
- Interfere with the Service or abuse our systems
- Submit another person’s government ID, passport, financial, education, or similar document without a lawful basis to process that data
- Use Document Check outputs as a substitute for regulated KYC, background checks, or official identity verification, or to unlawfully discriminate against individuals
We may suspend or terminate access for violations.
11. No duty to monitor
We have no obligation to monitor User Content but may review, restrict, remove, preserve, or disclose content at our discretion, including to comply with law or respond to complaints.
12. Intellectual property
The Service, including software, branding, logos, designs, and documentation, remains the property of Smitten Technologies and its licensors. These Terms do not transfer ownership to you.
13. Feedback
If you provide feedback or suggestions, we may use them without restriction, attribution, or compensation.
14. Third-party services
The Service relies on third-party providers such as authentication services (e.g. Firebase/Google), AI model providers (e.g. OpenAI, Google Gemini, Anthropic, xAI, and other configured models), search providers, cloud hosting, URL security services, media/transcription tools, document OCR / document-AI processors, identity and document registry / verification APIs (for example Surepass-class providers where configured), legal-record / FIR and court screening APIs (for example Deepvue-class providers where configured; name and address only — not ID numbers or images), and AI writing-detection services.
We do not control third-party services and are not responsible for their availability, accuracy, policies, outages, or security incidents. Your use may also be subject to those providers' terms. Registry lookups may send extracted identifiers and/or document images to those providers solely to generate your result. Legal-record screening, where configured, may send extracted name and address (and father’s name or date of birth only if already extracted) to a FIR/court provider; that is not the same as issuer-registry verification.
15. Subscriptions and payments (if offered)
If paid features or subscriptions are offered in the future:
- Purchases through Google Play are billed by Google and subject to Google Play Terms of Service and Google's refund policies where applicable.
- Purchases through the Apple App Store are subject to Apple's terms and payment policies.
- Subscriptions may auto-renew unless canceled before renewal through the applicable store.
- Fees may be non-refundable except where required by law.
- We may change pricing or plans with notice where legally required.
The current iOS and Android apps do not require payment to use core analysis features unless stated otherwise in the app.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMITTEN TECHNOLOGIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REPUTATION, BUSINESS, OR DATA, ARISING FROM USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY APPLICABLE LAW.
18. Indemnification
You agree to defend, indemnify, and hold harmless Smitten Technologies and its personnel from claims arising from your use of the Service, your User Content, or your violation of these Terms or third-party rights.
19. Copyright and complaints
Do not submit content that infringes intellectual property. We may remove content, restrict access, suspend Accounts, or cooperate with lawful investigations in response to valid complaints. Repeated infringement may result in termination.
20. Political and election-related content
The Service may process political or election-related content for informational analysis only. We do not endorse any candidate, party, government, or ideology. Verify political information independently.
21. Beta features
We may offer beta, experimental, or preview features that are incomplete, unstable, or discontinued without notice. Use is at your own risk.
22. Enterprise and organizational use
Businesses, media organizations, schools, governments, and other organizations use the Service at their own risk. AI Outputs are aids to human review — not substitutes for professional investigation, legal review, compliance, journalism, or due diligence.
23. Export controls
You must comply with applicable export control, sanctions, and trade laws. We may restrict access where required by law.
24. App Store and Google Play terms
If you download the Service through the Apple App Store or Google Play Store:
- These Terms are between you and Smitten Technologies only — not Apple or Google.
- Apple and Google are not responsible for the Service or maintenance/support obligations (except where store rules require).
- Apple and Google may be third-party beneficiaries of these Terms where applicable.
- If there is a conflict between these Terms and mandatory store terms, the mandatory store terms prevail for that conflict.
- For Google Play billing, Google's payment and subscription rules apply to in-app purchases processed through Google Play.

25. Dispute resolution
25.1 Arbitration (India)
Except where prohibited by law, disputes shall be resolved by confidential binding arbitration seated in New Delhi, India, conducted in English. The award is final and binding.
25.2 Courts
Where arbitration is unavailable or unenforceable, courts in New Delhi, India have exclusive jurisdiction.
25.3 Class actions
To the maximum extent permitted by law, disputes must be brought on an individual basis only, not as a class or representative action.
26. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
27. Electronic acceptance
You agree that accepting these Terms in the app or online constitutes a binding electronic agreement.
If these Terms are translated, the English version controls in case of conflict.
28. Changes
We may update these Terms. The current version is at https://smitten.co.in/terms-of-use. Continued use after changes become effective constitutes acceptance.
29. Miscellaneous
If any provision is invalid, the remainder stays in effect. We may assign these Terms; you may not assign without our consent. Provisions that by nature should survive termination (including intellectual property, disclaimers, liability limits, indemnity, and dispute resolution) survive.
These Terms, together with the Privacy Policy and AI & Media Processing Notice, are the entire agreement regarding the Service.
